Terms and Conditions of the Olivarium Onlineshop

1. Prices:
. All prices are in Euros (EUR) and include the Austrian legally effective VAT (Value Added Tax).
. The listed price is per piece or unit.
. The stated prices are in effect until changed.

2. Ordering:

. Limited or not in stock Items are not shown Online. Therefore Orders of limited Articles cannot be processed on line. Only by email can they be accommodated and confirmed.

. Minimum quantity is EUR 30 (thirty) including VAT. We do not accept orders under this amount

. The Buyer receives a Confirmation from the Online Shop. This is sent to the Buyer at the email address given by the Buyer. The Bill of Sale is effective based on the Online Order and our email Confirmation.

3. Delivery: 
. We ship by Package delivery. At this time deliveries for Online Orders are only possible to the following countries:
Zone 1: Austria, Germany
Zone 2: Belgium, Denmark, Italy, Luxemburg, The Netherlands, Poland, Slovakia, Slovenia, The Czech Republic, and Hungary
Zone 3: France, Great Britain, Greece, Estland, Finland, Ireland, Letland, Liechtenstein, Lithuania, Monaco, Portugal, Spain, Sweden and Switzerland
Zone 4: Norway, Croatia, Canada, USA
Per Order is a shipping cost dependent on the delivery, i.e :
for Zone 1 : EUR 9.90 including VAT,
for Zone 2 : EUR 18.90 including VAT,
for Zone 3 : EUR 24.00 including VAT,
and for Zone 4 : EUR 27.00 including VAT.
. On an order of over EUR 150.00 (one hundred and fifty) including VAT, the delivery is free.
. If a partial delivery is necessary, the remaining part is delivered free.
Unless another “ship to” address has been received, the merchandise will be shipped to the billing address.
. If we have received a false or incomplete address which results in the return of the Package, we reserve the right to charge the buyer for the resulting costs. The policy also applies to refused packages.

4. Delivery time:
. Orders received by us on a business day, will be processed within the next 24 hours or the next workday.
. Orders received on the Weekend or on a Holiday will be processed on the next workday.
. The package usually leaves the stockroom on the day after being processed. Delivery normally takes 2 (two) to 4 (four) workdays after the order date. We cannot be held responsible for any delay in delivery. Should the delivery for some reason be delayed, we will inform the buyer.

5. Payment and Security:
. A detailed Invoice is included with every delivery.

. We deliver after the credit card payment has been approved. For Customers in Austria we also accept PAYBOX payments.   

At this time we accept the following credit cards: VISA, MasterCard, Diners Club Card, American Express.
. Your credit card- or PAYBOX- information is protected from unauthorized access by a SSL keyed connection (“Secured Socket Layer” an Internet Security Protocol). The data is sent over the SSL connection from the server of our partner mPay24 online to the appropriate company, where this is automatically checked.

. The Online Order is in effect after payment is approved over the SSL connection by the Credit card institute or PAYBOX,
    
    
6. Claims, Exchanges and Returns:
. The legal requirements of guarantee are in effect.
. We only send products in perfect condition. Should the delivered products have transport damage please inform the delivery company in writing.
. Please control the delivery immediately as to content and completeness.
. Incorrectly delivered merchandise will be exchanged as long as the product package has not been opened. We pay the return shipping.
. Claims should be made within 48 hours after the delivery time by telephone or email under the contact information at the end of this document, after which step we will contact you. Until then please do not return the merchandise.

7. Guarantee and Customer Service:
. The Guarantee conforms to the legal requirements. Information over possible additional manufacturer’s guarantee is available in the product documentation.

8. The Purchase Agreement and Cancellation:
. The Purchase Agreement results from the Online order by the customer and our email confirmation of the order. Customers have the right to change or cancel their order within 24 hours after it is placed.  A message per telephone or email is sufficient.
. In addition the customer is not required to accept the order when within 2 weeks after receiving the products it is cancelled. The period of notice begins with receiving a written notification of cancellation. The cancellation must not contain a reason and can in writing (email at info@olivarium.com is enough) or by returning the merchandise at our risk. To maintain the period of notice it is enough to send a written return notice or the product to:

. The right to return applies to unopened Packages. Already used merchandise or products that have been removed from their packages cannot be returned. The costs to return the merchandise are born by the buyer. Please provide sufficient postage. By insufficient postage we will bill the customer for the difference. Please keep the proof of shipment.
. In the case of correct cancellation, the conditions binding both parties are ended.
Individually or specifically produced for the customer or products that because of their composition are not suitable to return or that could quickly spoil or the expiration date in the mean time is exceeded are not returnable.
Please contact us by telephone or email before the return or exchange of foodstuffs.
The cancellation right is not in effect with business with Companies.

9. Data Protection:
. The AGORA Distributions- Handels GmbH uses your data solely for processing your order. All customer data is stored and used in accordance with the Austrian data protection laws and telephone service law. You have at any time the right to costless information, justification, closing and erasure of your stored data. Please send your request to info@olivarium.com or by post. We do not give your personal data including your home address and email to third parties. The only exception being our service partners with whom we work to fulfill your order (for example the delivery service and the payment processing service). In this case the transmitted data is only the necessary minimum. We use technical and organizational security measures to protect your data against accidental or intentional manipulation, loss, destruction, and against the access of unauthorized persons. Payment data is transferred in code (128-Bit SSL).
In this shop temporary “Session Cookies” are used. These bits of data are only generated during the time on olivarium.com.

10.Text of Bill of Sale:
The text of the Bill of sale is stored. You can store the general terms of purchase and look at this sight at any time. Your actual purchase order cannot be accessed by you per Internet for security reasons and will be handled in confidence based on our security regulations.

11. Miscellaneous:
. Our entire Offer is meant for the general public. Wholesale sales are reserved.
The merchandise remains the property of AGORA Distributions- & Handels until it is completely paid for. The Purchase Agreement is subject to Austrian law.
. The Court of Jurisdiction is Vienna, Austria/EUROPE. (applicable only to B2B clients or legal persons).

12. Subsiduary Clause:
Only the General Conditions of Sales business practices of olivarium.com (AGORA Distributions- & Handels GmbH) are in effect. If or should a regulation in this contract become ineffective and/or not possible to follow, the rest of the regulations remain in effect. Instead of the ineffective and/or not possible to follow regulation the next closest legal regulation becomes effective.
